YProfile terms of service

These Terms of Service (the "Terms") govern the conditions and procedures for using YProfile (the "Service"), a profile page creation, management, and analytics service operated by BizCode Co., Ltd. (the "Company"), and set out the rights, obligations, and responsibilities of the Company and its Members.
Article 2 (Definitions)
- "Member" means a person who agrees to these Terms and uses the Service through a THE-Y account.
- "Page" means a profile link page that a Member creates and manages within the Service.
- "Card" means a content unit that makes up a Page, such as links, galleries, music, maps, file sharing, schedules, contacts, or notices.
- "Paid Plan" means a paid subscription product designated by the Company, such as Pro or Team.
- "THE-Y Credit" means a closed-loop unit that can be used for paid features of participating services, including YProfile, within services provided by THE-Y. Cash withdrawal and transfers between users are not supported.
Article 3 (Posting and Amendment of These Terms)
These Terms take effect when posted on the Service or otherwise announced.
- The Company may amend these Terms to the extent permitted by applicable law. Amendments will be announced through in-service notices at least 7 days before the effective date (30 days for changes unfavorable to Members), stating the effective date and reason for the change.
- If a Member continues to use the Service after an amendment takes effect, the Member is deemed to have agreed to the amended Terms. A Member who does not agree may terminate the service agreement.
Article 4 (Account and Authentication)
- Sign-up, login, email verification, and password changes or resets are handled through THE-Y, the Company's integrated authentication service.
- Members are responsible for keeping their account access information secure and must notify the Company immediately if they become aware of unauthorized use or a data breach.
- The Company may refuse registration or restrict use of the Service where a Member has stolen another person's information, registered with false information, or claimed a page address in bad faith using another person's trademark or name.
Article 5 (Provision, Modification, and Suspension of the Service)
- The Company provides profile page creation, content card configuration, visitor analytics, and team collaboration features.
- The Company may modify existing features or add new ones to improve service quality, and some features may be offered first in a preview or beta form.
- The Company may temporarily suspend the Service for unavoidable reasons such as equipment maintenance or force majeure, and will provide advance notice. Notice may be given afterward in urgent cases.
Article 6 (Paid Services, Payment, and Automatic Renewal)
- Paid Plans (Pro, Team, etc.) apply on a per-Page basis, and Members may choose a monthly or annual billing cycle.
- New Paid Plan purchases and renewals are processed through THE-Y central checkout. The checkout displays the USD base price and transaction terms, and the Member chooses an eligible provider offered for that transaction, Toss Payments or Paddle. If Toss Payments settles in KRW, the exchange rate disclosed at checkout and stored with the order applies. The Paddle Buyer Terms apply to Paddle transactions to the extent applicable.
- For monthly and annual Paid Plan renewals, THE-Y may use the Member's THE-Y balance first and charge an agreed saved payment method for any shortfall. A Member may schedule cancellation before the next renewal date. An active plan remains available for the paid period and is not charged again after that period ends.
- If a payment fails or falls past due, use of the relevant Page's Paid Plan features may be restricted; access is restored immediately once payment is completed.
- Prices, additional page fees, benefits, and limitations follow what is shown on the checkout screen or in in-service notices.
Article 7 (Withdrawal and Refunds)
The Company handles refunds under the Republic of Korea's Act on Consumer Protection in Electronic Commerce, the terms of the selected payment provider, and any other applicable mandatory law.
- A Member may request a refund of the unused paid amount attributable to a payment within 14 days of that payment. Issuing credits to the Member's THE-Y balance does not by itself make them used. Amounts for which Paid Plan features have begun because a paid slot was assigned to a Page, THE-Y Credits actually used or held for an in-progress transaction, and promotional, administrative, or migrated balances that do not represent a cash payment are excluded from this voluntary refund policy unless applicable law requires otherwise.
- If the Service provided materially differs from what was advertised or agreed, a Member may request a refund or correction within 3 months of the date of supply, or within 30 days of becoming aware (or being able to become aware) of the issue.
- Cancelling a recurring Paid Plan does not, in principle, entitle a Member to a prorated refund for the current billing period already in progress; cancellation takes effect at the end of the current billing period.
- Refund requests may be submitted through THE-Y Billing or by email to official.yshorts@gmail.com. If the original payment was processed by Paddle, the buyer may also use the transaction receipt link or Paddle's buyer-support route. A clear withdrawal or refund notice delivered through any method required by mandatory law remains valid. After verifying the Member, order, and usage, the Company reviews the request under applicable law and the selected provider's policy. An approved refund is processed by the original provider, Toss Payments or Paddle, and returned to the original payment method.
- Refunds may be restricted where a benefit was obtained through fraudulent means, where use of the Service has been restricted for a breach of these Terms, or where refund abuse is suspected.
Article 8 (Rights in Content and Data)
- Members retain rights to content (images, videos, text, files, etc.) they upload or create on their Pages.
- Members permit the Company to store, transmit, and display such content solely to the extent necessary to provide the Service, maintain its stability, and improve its quality.
- Members must ensure that content they upload does not infringe the copyrights, trademarks, or rights of publicity of any third party, and are solely responsible for any liability arising from such infringement.
Article 9 (Prohibited Conduct)
Members must not engage in any of the following while using the Service:
- Using the Service by stealing another person's identity or providing false information
- Claiming a page address in bad faith using another person's trademark, name, or service name
- Posting or distributing unlawful content, or content that infringes the rights of third parties
- Crawling or reverse engineering the Service without authorization, or interfering with its normal operation
- Using a fraudulent means of payment, exploiting vulnerabilities in the payment system, or abusing the refund process
- Any other act that violates applicable law or these Terms
Article 10 (Restriction of Use and Termination)
- The Company may, after prior notice, warn, suspend, or terminate the service agreement of a Member who violates Article 9 or otherwise impedes operation of the Service. Where urgency is recognized, the Company may act without prior notice.
- A Member may terminate the service agreement at any time through in-service settings or by closing their THE-Y account. Any active Paid Plan will be handled in accordance with Article 7.
Article 11 (Limitation of Liability)
- To the extent permitted by applicable law, the Company is not liable for service interruptions caused by events beyond its reasonable control, such as force majeure, power outages, telecommunications carrier failures, or outages of third parties including THE-Y, Toss Payments, or Paddle.
- The Company does not guarantee the accuracy or reliability of content posted by Members and has no obligation to intervene in disputes arising between Members, or between a Member and a third party, in connection with the Service.
- The Company is not liable for features provided free of charge, except as required by applicable law.
- Nothing in this Article excludes liability for damages caused by the Company's intentional misconduct or gross negligence, or limits any consumer right that cannot be limited under applicable law.
Article 12 (Governing Law and Dispute Resolution)
- These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
- If a dispute arises in connection with use of the Service, the Company and the Member will negotiate in good faith to resolve it amicably; if resolution is not reached, either party may bring an action before a court of competent jurisdiction under the Civil Procedure Act.
- Members may also seek redress through relevant dispute mediation bodies, such as the Personal Information Dispute Mediation Committee or the Electronic Transaction Dispute Mediation Committee, in addition to litigation.
